| Post subject: | Lawyer review of Mattamy Sales Agreement |
Has anyone had their lawyer successfully change any of the elements of the sales agreement? We signed last night so we have 5 days for lawyer review -- i'm thinking we will try to find someone but i bought new before and the lawyer spent all of 10 seconds reading the agreement saying 'this is all standard and even if it was not, they wouldn't let us change it anyways' I'd be really interested in the areas that were stricken or added. I wish i could add a section that if we were delayed beyond July 1st that they would pick up the HST tab!!! |

HST only applies for houses more than 400k You should make sure your lawyer is putting caps on Paragraph 9, Schedule 1 What type of discounts did you get and what house did you buy? |

I have purchased new homes in the past from other builders including Remington Homes and Gold Park. My lawyers always deleted or added to the agreement and the builders expected it. Any lawyer who would change nothing sounds lazy and or incompetent IMHO. |

Did you change anyting related to HST? specially if they delay the house after July 1st, what would can we do "Legally" How much did laywer charge, you . we have to pay legals fee for closing. which is usually 700-800, did he charged to some extra for this review. Mattamy is reccomnding a lawyer too, I don't know if it's a good idea to use him??????? |

I asked my lawyer the Q about the HST. I used Harpreet. Seemed really nice, and she's got a good system. She essentially has a version of the Mattamy contract that she has highlighted sections to note to the consumer, and also her customary changes that they accept. They accepted 2 out of 3 of her changes and another with minor changes. Zilch. She said Mattamy would agree to nothing on the HST and I because I was in my 5 day waiting period, I could walk away or accept the fact that delay increase the cost of the house substantially. Based on what I have seen and experienced, the last person on earth I would ever go to would be a Mattamy recommended lawyer for the closing of a house with Mattamy. No, I'm playing the odds. Most (70%) of Mattamy homes close on time -- we are scheduled for March. Looks like 20-25% close within 1-2 months of the original close date (still before July 1st). So if I'm in the 5-10%, well, it happens badboy09 wrote: ok, I see. Then, did you walk away from Mattamy?

By no means are these official or anything more then serious guesswork. I should have prefixed that! 70% is the claim given by the sales person that sold us the house. I also took a look at all of the Vista 1A homes where I bought and looked at people's closings from the forum posts that talk about who lives in what phase and street and looked at what people's close date, actual date, and also how long there were delayed. Extremely un-scientific. I need to be careful else people will think I actually know what I'm talking about!! oakvillehomes wrote: Interesting stats...
