I had a quick look at milton.ca but couldn't find much in regards to shed placement in a backyard. Does anyone know if it has to be a certain distance from a fence? TIA

Thank you Shannon for posting this. I know that it has to be at least 2 feet away from the property line and from what I understand (correct me others if I am wrong) a maximum of 3.0 metres in height.

I have been trying to get in touch with the City for 2 weeks now leaving numerous messages. The people behind us have build a shed (which looks more like a small house). And have stated that the 3.0 metres is only to where the roof starts and is not the maximum height??? I am pretty sure the shed is at least 13-14 feet tall.

Does anyone know what to do if the Bi-law is not followed?

HI Shannon and Emmasmom

Please check Table 4A the MAXIMUM height is 3 metres that is ground level to the top of the accessory building not the start of the roof.

Call 905-878-7252 press 0 for the operator and ask for the Bylaw Enforcement office who will send an inspector to inspect the shed to make sure if conforms. If it does not, or exceeds 100 square feet without a building permit it can be ordered to be removed.

Hi Emmasmom

No, a building permit is required for all structures over 10 metres square or 100 square feet. All structures have to meet the zoning by-laws and building codes regarding height, setbacks and use.

To exceed the bylaw requirement, Shedman would have to get something
called a minor variance.I'm not sure what the bylaw permits, but let's say it's 10 feet. If Shedman wants to build a 14 foot
shed he or she would have to make a formal application to the Committee of Adjustments and convince the Committee that a towering shed is a good idea.

Shedman would also have to notify all neighbours within 200 feet of the subject property of his or her application.

A formal hearing is then held and you can voice your objection at the hearing.

The Committee of Adjustments then renders its decision.

The key to all this is that the variation has to be MINOR.

Wow... thanks B&B!! That is great to know.

Shedman is not going to be happy with us. And I hate to make enemies, however I can't stand looking out my backyard anymore. All I see is this gigantic structure! Not only is it upsetting but very irritating!
