If you are set on getting your money then your next letter should state that this is the fial notice and if you do not recieve payment by such and such a date than yor next correspondence with them will be through your lawyer. It is a contract. |

Hi! The exact same thing happened to us last year. We purchased the biggest pie shaped lot on our street and wanted to get a fence. I had to go around and speak to 6 different houses about it. All agreed. A few days before the post hole guys were scheduled to come one of our neighbours left a message saying "sorry, but it wasn't in their budget this year". But a few days before I was in their house and they said that fences make good neighbours and they didn't want to look bad by declining! Then all throughout the summer we watched them install a deck, stamped concrete for their driveway and pathway, install 2 sheds, buy a new truck and buy 2 trees! They even put a gate on part of the fence they got for free on the other side! Can you believe this?? |

What a nightmare situation, my sympathies go out to anyone who has had to endured that. What is wrong with people that they can live with themselves doing this. Luckily I had no such issues with my neighbours who are all fantastic. I didn't spearhead the fence movement, a couple of them took charge and I couldn't imagine any circumstance in which I would have left them hanging like that and I was not in a very good financial situation at the time, but I wasn't going to make that their problem. I wish I could offer advice that would prove helpful, but all I can suggest is sinister ways to get revenge that is probably best left to the imagination. Other than that, I would definitley look at my legal rights. Whether or not it proves to be worth it, I don't know, but I'd look into it all the same. I can only suggest for others in the future: if you're the one organizing it, take deposits from everyone. If a neighbour is hesitant to give you a deposit, that might be a warning sign. Invite them to be equally involved in the organization of this so that they know you're not trying to rip them off. Good luck with it! S. |

just curious as to why one person would have put up the money upfront and didnt get cheques from everyone to the fencing company for their share? |

I was actually wondering about this, myself. I am a first time home buyer, I've never done this before and don't know what the protocol is. Who approaches who first, how it all works. Etc. I assumed the cost would be shared by whomever the fence was shared with, but I guess you have to sort out when everyone has enough $$ to go ahead as well. One person cannot FORCE the other person to pay for a fence they may not be able to afford just at the time, right? Can they? If you are approached, you do have the right to say "now is not a good time" if you cannot afford the cost just then, right? Or do you have to do whatever your neighbor wants without question? D. |

Thank you. So it seems most expedient if both parties agree in advance, or the party who does not agree ends up having to pay 50% of a fairly nominal amount. Cheers for the link. D. |

Is the fence on your property or is it stradling the property line. A good neighbour of mine told me a neat trick that the town had told a person who whas having a fencing problem. That was to paint the fence bright flourecent pink on the side that wouldn't pay for the fence, then see how fast they would pay & paint the fence another colour. The only concern would be...what if that person likes bright florecent pink Tim |

I have heard that if you contact the city they will add the cost of the fence to their property tax believe it or not. Now I'm not 100% sure but I would look into this, then the government pays you. See the Ministry of municipal affairs. If a contract was made even verbally you will win a case. |

There have been many conversations about putting up a fence. All of them result in.. Read the by-law. It documents in there who is responsible for what, and what to do when those responsibilities are not met. |
