Today marks the 30th anniversary of the Canadian Charter of Rights and Freedoms. I just thought it was something worth noting, and celebrating a little.

I can explain for you Zeeshan, what some of the problems are, so that you can understand.

For one, the charter states that any person charged with an offence has the right to be tried within a reasonable time yet there is nothing in the charter preventing delays. Therefore thanks to these provisions in the charter, thousands of criminals and drunk drivers have been set free. In fact, the charter itself is responcible for many court delays, compounding this problem.

As well, the charter also provides fundamental freedoms including free speech and freedom of peaceful assembly yet this only applies when it is convenient for governments. Take for example the people in Caledonia who have lost those rights. Caledonia has neutered the charter because it has failed to protect the citizens in that comunity from theft, abuse, violence, and yet the offenders are not punished.

There are other issues as well, the bottom line is that the charter IS flawed and the charter often protects the wrong people. With a bit of research you will see for yourself.

I agree, Trudeau was a twit and his son Justin is a moron and a dick.

As a rich punk in the 1930s and early 1940s, Trudeau was no champion of democracy and individual freedoms. He was instead an ardent Quebec nationalist who, during the worst of the war years, admired fascist dictators and regarded reports of Nazi atrocities as British propaganda. In the 40's he also plotted treason against Canada and actively promoted a revolution to establish an independent Quebec solely for Catholic French Canadians.

What a clown he was.

I had no idea so many disagree with the charter.

To those people, what would be an alternative for a sovereign nation? South Africa used our charter as a model for drafting theirs in the '90's.

Im sure the are flaws but there are loopholes in the entire legal system. As for Caledonia, i think the province has learned from Oka and Ipperwash. If they really had to, they could have brought in the War Measures Act the way Trudeau did with the FLQ. To fault the charter for Caledonia is a little extreme.

I also remember truckers doing the same thing on the gardiner due to fuel prices....u feel the same wqy about them?

The charter separates us from the British, no? With no charter, we'd ultimately be under British law. Sort of defines us as a sovereign country....other than Vimy Ridge of course.

Welcome to the forum. If you considered yourself right-wing before you came here, you're in for a shock. Some of the regulars here make Republicans look friendly.

For the record, I like the charter, including the notwithstanding clause. I think it is important for the courts to stop unjust laws, but I also think that it is important for politicians to have the final say, not judges.

Trudeau was a gear box and embarrassment to our country. When was the last time anyone here used or invoked their charter of rights?

The Charter exists to protect the criminals and the only people that benefit from that are the criminals themselves and the lawyers that represent them.

We were free before the charter came to pass all it did was help Trudeau cram his social engineering bullshit down our throats.

I piss on that rag.

Honestly, I posted it because I thought it was worth noting. Canadians complain that they have no history, no tradition to celebrate. Here's a piece of history that I believe is worth celebrating; something that really impacts our lives today. Pierre Trudeau was a fascinating man in a way he can still totally polarize us over a decade after his death.

The man had guts, and vision to at least try something different. He achieved something in the agreement of 11 of 12 provincial/ territorial leaders on one document (remember Quebec didn't sign on, and Nunavut didn't exist yet). In a country as diverse as ours is, that deserves applause. We do invoke the Charter- we enjoy the right to speak freely, to assemble freely, and the right to Equality. The right to Equality protects us from discrimination based on race, religion, sexual orientation or gender.

Like Trudeau or not this is part of history. The Charter is something to be proud of instead of doing the typically Canadian thing and putting it down.
