Check your legal documents from the sale, it IS possible for the vendor to do it, but I know that Sundial, for example, definately did not do it. The first three items will be something like:

Selling Price
GST
GST Rebate

If the GST is 6% of the Selling Price instead of 7%, then they've adjusted it for you. If it's 7%, chase the government for the money!

I am in the same situation, I bought my house in August 2005 and closed on July 13, 2006.

I also just received a letter from the Canada Revenue Agency stating that the builder already credited us the GST New Housing Rebate at the time of purchase. You can see this reflected in the Statement of Adjustments.

However, I think there is confusion about the GST New Housing rebate that every new home buyer is eligible for vs. the GST Transitional rebate that new home buyers are eligible for if they were originally charged 7% GST by the builder but closed after July 1, 2006 when the GST rate was 6%.

I think the letter you recieved refers to the GST New Housing rebate and not the GST Transitional rebate.

The new Housing rebate is different from the Transitional GST rebate which is the rebate we should be getting. You or your lawyer should be applying for it using the form on the attached link.

Where do we get the Statement of Adjustments from? Does our lawyer send it to us or Mattamy? I do not have anything like that and I closed almost a month ago.

Derek - your lawyer provides that, and he/she is supposed to do it with that big bundle of paper you get on closing date, it details how they came up with the amount of money they requested from you.

Derek,

It may be that your lawyer prepared the documents and has them waiting for you at his/her office. Normally you have to visit your lawyer's office (on or after your closing date) a second time to pick up a large envelope filled with the completed paperwork which you didn't receive prior to closing because they were still being worked on. The documents would all be in there. The lawyer's office does not always call you right away to pick them up, so you may just want to give them a call and let them know you're coming down to get them and the receptionist will usually have them waiting for you when you arrive. :)

just an update. our lawyer said that we have to apply for the rebate after closing, with the purchase & sale documents. just so there were no suprises after we applied (i.e. mattamy already getting the refund, etc.) i emailed our customer service rep for clarification.

she replied quickley as such:

Thank you for your email. Mattamy will be closing your home at the GST rate of 7%. After you have closed your home, you may apply to the Canada Revenue Agency for the Transitional GST Rebate. The following link will direct you to the online form that you will need to fill out to apply for the 1% GST rebate:

http://www.cra-arc.gc.ca/E/pbg/gf/gst193/gst193-06e.pdf

You will also need Mattamy’s Business Number which is 899 754 055 RT 0068. I hope this information helps. Should you have any further questions or concerns, please feel welcome to contact me. Have a nice day!

btw, the GST/HST new residental property rebate numbers are needed to fill out the form. that info will be on the sales documents that you sign with the lawyer.. (again, the transitional rebate only applies to you if you signed your purchase agreement before may 3,2006 and take possesion after june 30,2006)

now.. we don't close for 3 weeks.. has anyone applied & recieved the rebate?

i will post when we do... i'm not sure how quick these government rebates are, though.

Hi,

I brought my house Feb. 2005 & closed on July 27, and sent the rebate info the same day of closing. Though we also got a letter saying that we weren't getting money back for the New housing rebate. We got our money about 2 weeks ago for the Transitional Rebate because Mattamy credited us the New Housing Money already when we signed with the lawyer, I called them to inquire when the money was coming during that long awaited time( not that I needed the money!!!) and they said it takes about 4 to 6 months until you receive anything. So, it may still be awhile until you see anything! I hope that helps you out!! :D

Hi again, I just wanted to let you know my neighbour who sent the forms in about a week later then me called the government today. They said that they are extremely behind on the Transitional rebates and she should be receiving it sometime in late December, she is very anxious too! But if you really want to know give them a call and they'll tell you if it's been processed, and if it has you can find out how much you'll be getting back, and when.

LOL they're behind on getting our money back to us, but lets US try and be behind paying them sometime. I'm sure they'd be just as understanding as we're expected to be. What is the government's going rate on penalties and interest for late payments? :roll:
