I do not think you can sell your service to someone can you?

usually a condition of home sale is that the new owner assumes the contract, you didn't do this?

If you make it a condition of sale, then they are obligated to take it over aren't they? How can a lawyer close the deal on your house if he does not have a signed contract between Voxcom and the new owner indicating that the condition has been met? A lot of houses state you must take over the alarm contract in their listings. Is this enforceable?

Did you receive bad advice from your agent or can someone clarify what can be done to prevent this (if anything) from happening to anyone on the site who may be in a similar situation?

When we sold our house, we had a ADT contract that we offered to the new owners. They opted not to take it, so we had to pay the contract off after we moved out. Sad thing about it was if they agreed to finish off the contract, they would own the system.

It becomes another negotiating factor in the agreement. Generally, there is less than $500 remaining on the contract, so it never really becomes a deal breaker.

You do see 'buyer must assume alarm contract' written on many listings, but that doesn't necessarily mean that it makes it onto the final agreement of purchase and sale(APS). If the buyer doesn't want it, they put in a condition that the seller must pay off the contract prior to closing. If the price is right, voila - home is sold. The lawyers will make sure whatever is written into the APS is completed.

Yeah, for the couple of Hundred dollars we had to pay off, selling the house more than made up for it. But it is the little things that add up.

Some friendly advice - ask them, ask them nicely, heck, maybe even bring a bottle of wine. You'll get a lot further ahead that way.

If they say no, make a quick call to your real estate lawyer for advice. Unfortunately, if the deal is closed and the components are still in the home, you might find out that they aren't yours anymore to remove. That's why I suggest asking nicely!
