I can also vouch for no hit and run charges if someone hits your car in a parking lot. Happened to us and police told us that when we told them someone did a hit and run on our car. Its a non moving violation. That's why I take up 2 spots now. You can literaly drive around hitting cars in a parking lot and nicking doors when you open them and nothing can be done. The person can just deny it was them. Probably cause if you have a nick on your car, you can just accuse someone that price matches to get them back. There would be a lot of revenge false accusations.

Years ago, I was pulling out of my spot when some old lady in the spot directly behind me began to do the same – without looking behind her. I saw her, laid on my horn (I couldn’t shift to drive and move forward in time) – she just cruised right back into me. I pulled back into my spot, and she just kept driving. I ran up to her window and was like WTF?! She rolled down her window, said “your car’s fine”, and drove off. My car was not fine. I got her plate and called the cops. They spoke with the woman, but informed me that because it was a parking lot, they could not press charges.

So the moral of the story is that if you ever hit a car on private property, just go home and laugh. You will never face any repercussions for being a douche.

Parking lots are auto insurance carriers' biggest headache. That is why they deem everyone at fault.

This is not true...there is set of rules for fault, and even specific ones for incidents in parking lots!
No headaches.

Go make a claim for an accident in a parking lot (hopefully you will never have to but....) and please post your experience here.

Everyone ends up being deemed at fault for almost all parking lot fender bender claims.

The same could be said about any accident, if not reported to the police, no?

From expericene, if you car is parked, and you come back and it has been hit, you are not at fault.
If you are pulling out of a parking spot and hit a car driving by, the car pulling out is at fault.

Damages on a car can usually tell the story of what happened.

Nope, not in parking lots.
Car are almost always parked ass to ass.
You back out and hit someone...your ass is hit and so is his.
Go prove who hit who.

yeah, but I would say the majority of people are honest people, who when they call to open a claim they admit that they have hit somebody.
obviously not everyone, but for the most part.
If you call your insurance company, and tell them that your car was parked, and you came out and it was hit, there is no way they will say, no, i think you hit the parked car.
They will tell you to report a hit and run to the police, hold you not at fault, but you will still have to pay your dedcutible.

Majority of people are honest? With the car insurance rates being sky high? Perhaps 10% are sorta kinda honest but the rest will claim to have been hit or will never even make a claim, when it comes to parking lot fender benders. This is why you will end up paying a deductible. Insurance companies have bigger fish to fry when it comes to auto insurance claims and only if you work in the industry, you will understand/know this already.

Here is an easy way to remember parking lot rules:

If your car is in motion..you are at fault (50%) regardless of the circumstances.
(If enough witnesses are available you MAY be able to prove otherwise)
If your car is parked and you are in it, you are not held responsible.
If your car was hit while it was empty, that is a hit and run and must be reported to the police, if it isn't then the insurance company will not pay.
For any other accident, there are fault determination rules which are guidelines with diagrams that insurance companies follow. The police can say you aren't at fault but the insurance company can say otherwise..such in the case of weather related accidents.

I have worked in the insurance industry for over 10 years...it doesnt take long into a conversation to figure out who is trying to bullshit their way through a claim.

You pay a deductible because in the Ontario no fault system, there needs to be two identified parties, so that you can proceed dcpd (direct compensation for property damage)
In a hit and run incident, there is no identified third party, therefore the coverage falls under the collision coverage, subject to the deductible, and as long as its reported to the police as a hit and run, it will be a non ratable claim.

if the person who hit the parked car left a note, we then have a identified third party, and the claim can fall under dcpd, and the person who has the parked car's deductible can be waived and also held not at fault.

they will pay, if you have collision coverage, but it will be an at fault claim, single vehicle accident, also subject to your deductible.
