Hi Tim
Your welcome, but the thanks should go to Paul & Nelson in the Engineering Dept. who got Mattamy's contractors to clean it up. Edwards Ave. has not yet been assumed by the Town for maintenance so it is still Mattamy's responsibility until the Town assumes ownership hopefully later this year.

OK - so what exactly does it mean when the town assumes a road? For example - Edwards Ave. The town tickets cars on it, collects garbage on it and plows it. The only thing it seems it wasn't doing was keeping it clean. What is the difference when it is assumed? :?

Hi Tim and woodclan
To answer your question municipalities assume or take ownership of the roads after 3 to 5 years according to Paul Cripps the Town Engineer before the assumption the builder is responsible to ensure the roadway meets provincial standards of construction ie. no settling etc. while maintaining such things as streetcleaning, catch basin cleaning etc to Town standards.

There has been cases of communities assuming roads too early and finding the road settling so much the manhole covers looked like mini volcanos and had to go back and reconstruct the road.

The Town also holds a security deposit from the builder until the road is assumed by the Town.

Hopes this helps.

WHat about line painting? My firends wife got T-boned at Clarke and Bennett by some 17 year old speeding and having passangers against his license requirements. I am sure if stop blocks were painted on the road he would not have missed the stop sign.

Sounds like there may be some negligence and someone may be open to a lawsuit.......

Is the builder allowed not to paint the road because the Town has not assumed it??? I am sure the crossing guard there would appreciate it too!

Matt
