Leaking is not the same as condensation.

Leaking happens when moisture penetrates the building envelope.

Condensation occurs when damp air meets air of a significantly different temperature.

So if it is a humid hot day, your cool basement will condensate and the water will form in various places.

When you move in you _must_ get a DE-humidifier. Turn it on and let it run all the time. Get one with a hose and let it run into your floor drain.

Water usually does form behind the insulation, I see it all the time, and I would recommend pulling the plastic out and letting it dry out, otherwise mold can form.

if the water is brown, chances are it is a leak because of the mud from outside. That is how I found my leak and there was an obvious crack. Best bet is to wait for them to powerwash your floor during clean up then then judge after it dries.

I'm getting really annoyed because if I had known this, I would never have bought...a wet basement is not something that I'm looking forward too. Also why should I have to spend money now on a De-humidifer for the next four years when all this could have been avoid.....

Basically I want better answer and for the builder to stop treating me like I'm a girl.....

New houses are made out of many new materials. These materials start to dry out over time and the moisture has to go somewhere. Wood, concrete, drywall, paint, carpet, everything starts to give off moisture and with new houses being sealed so tight, the moisture has no where to go.

This is a normal thing.

Condensation is just very noticable these days because of the increased humidity.

If the insulation is completely soaked, then yes, get them to do something about it.. or come back and replace it after you have moved in and got your de-humidifier going.
