No, the town cannot reject it if all approvals are met. Basement apartments are LEGAL in Milton.

Do a quick search on this forum, you will see threads dating back 6 years about the legality of basement apartments in Milton. If when you 'signed' up to buy in Milton you were told it was illegal then you needed to have done your due diligence before buying at that point.

I'm curious....proudowner, are you renting out your basement or is your basement a separate apartment for extended family members? Your posts come across as pro-renting. Not judging, just wanted to ask about how much of an impact having a separate family unit in the house has on the main family unit.

I am also intrigued by the ratio for/against income earning basement apartments in Milton.

I am pro 'respect your neighbours choices'. Especially if they are doing something legally within their rights. I don't rent my basement out, it's not finished. When I do finish it, it will be for my enjoyment and my family alone and not as an investment property - my choice.

OP came asking the correct questions, perhaps she should have just done a job like below without any permits like prickly_pete's neighbour?

BTW, I moved out of Milton a while ago if that counts for anything.

I agree with Proudowner - its freedom of choice

Town of Milton does allow basement units and re-zoning is not required

Thanks for the comments and concerns.

One area not mentioned in this discussion is not only the Provincial requirements for apartments to meet the Ontario Building Code and Ontario Fire Code including separate entrances and fire separations. But also the municipal zoning by-law requirement for additional parking for the separate unit. The Milton Committee of Adjustment recently DENIED a basement apartment on Mc Duffe Cr. due to the owner not having sufficient room for the additional parking as required in the zoning by-law. There is also other restrictions on apartments in certain residential zones depending on the type of house.

Before anyone starts a basement project including washrooms check with the Town building department to ensure the project meets the Building Code and has the necessary permits.

Having the proper permits and inspections done first can save a homeowner much aggravation and additional costs later to fix illegal work and could also jeopardize a future sale or financing of the property.

Curious Colin, how many have been approved and how many denied in the last year? Is this denial a one off or the norm considering it is legal once you meet all the requirements in Milton unlike Brampton which will not even accept any new basement being converted to a rental?

So...someone on our street has a basement apartment that they rent out. It has not been approved by the town. When someone from the town came out to check, they rang the doorbell, asked them if they had a basement apartment, the owners said no, so the guy from the town left.

We see extra cars on the driveway, and people clearly not from the same family using the garage entrance as their way into and out of the basement.

What is the policy for the town to check these things?

How do you know they are renters? They could just be swingers for all you know.

How do you know it has not been approved by the town? How do you know that the town went to their door and inquired about a possible basement apartment and that the owners said no?

Unless you have vampires or zombies living near you like I do, who cares if people are renting out their basements? There are tons of detached/semi-detached/townhouses/condos in Milton being rented out. Does that upset you?
